Court Denies Waititu’s Request to Reduce Sh53mn Bond, Prohibits New Applications


Former Kiambu Governor Ferdinand Waititu has encountered yet another legal hurdle as the High Court dismissed his request to modify bond conditions that necessitate him to provide a Sh53 million bank guarantee.

  The court rejected his appeal to replace the guarantee with a cash deposit, which means Waititu will continue to be detained while his appeal is ongoing. During the hearing on Wednesday, Waititu’s attorneys contended that commercial banks had refused to issue the guarantee, rendering it impossible for him to meet the bond requirements. His legal representatives also mentioned that he had been undergoing medical treatment at Kenyatta National Hospital but remained in custody due to the strict conditions. Nevertheless, Justice Lucy Njuguna refused to alter the orders. “I will not change those orders. Frankly, I did the best I could based on the evidence presented to me. You provided material that convinced me, and I was generous enough to grant those orders,” the judge stated. Additional applications prohibited She reminded the defense that this was not the first instance of seeking relief and highlighted that other defendants in the same case, who are still in custody, had expressed concerns regarding delays. “That’s why I granted 120 days, and for the record, the 120 days commence from today. It is on this basis that I stated no further applications should be submitted so that we can focus on the appeal and resolve it promptly,” Justice Njuguna remarked.
