EACC Opposes DPP's Request to Dismiss Forgery Case Against Senior UoN Official
The Ethics and Anti-Corruption Commission (EACC) has expressed its disapproval of the Office of the Director of Public Prosecutions (ODPP)'s application to drop a corruption case against Brian Ouma, a high-ranking official at the University of Nairobi, who is accused of forging academic credentials and unlawfully acquiring over Sh32 million. During the proceedings at the Anti-Corruption Court on Tuesday morning, the prosecution announced its intention to withdraw the case. Nevertheless, the EACC contested this decision, highlighting that the accused had previously secured conservatory orders that halted the proceedings. The Commission stated that the conservatory orders, which were issued on July 9, remain effective and were granted in petitions submitted to both the High Court and the Labour Court, where both the ODPP and EACC are involved. "The aforementioned petitions have not been retracted, and it would be prudent for the accused to first withdraw those matters before any actions are taken in this case," an EACC representative informed the court. Ruling Scheduled for October 30 The Commission further contended that the petitions are directly related to the ongoing criminal case, and thus, withdrawing the case prior to resolving the petitions would be premature. In reply, the prosecution indicated that discussions among the parties are ongoing to address the unresolved issues and assured the court that the case would be withdrawn once these matters are settled. The court has ordered that a ruling regarding the application to withdraw the case will be issued on October 30. Ouma faces charges of forgery of academic documents and unlawful acquisition of public property exceeding Sh32 million, allegedly received between 2015 and 2025 while holding various senior roles, including Deputy Director (Fundraising, Donor Relations and Partnership), Director of Advancement, and Acting Chief Operations Officer at the University of Nairobi.
