Is the CEO of the Dock Workers Union in office unlawfully?
As the leadership crisis within the Dock Workers Union persists, new information has emerged indicating that Chief Executive Officer Renson Thoya is occupying his position illegally.
Reports suggest that Thoya's contract lapsed in April 2024 and was not renewed by the board. A faction of the Dock Union Workers is now seeking to petition the Ethics and Anti-Corruption Commission (EACC) to probe the situation and determine whether Thoya has been receiving salaries and allowances unlawfully.
Sources indicate that Thoya has been drawing a monthly salary of Ksh. 168,454 without a valid contract. This constitutes an illegality, and the EACC should act promptly to ensure his arrest, prosecution, and the recovery of all funds disbursed to him by the union.
It is believed that Thoya is under the protection of the union's Secretary General, Sang, who, despite the expiration of Thoya's contract and the board's refusal to renew it, has continued to facilitate Thoya's illegal tenure in office.
Another matter that warrants investigation by the EACC is a claim from union members alleging that, under Sang's directives, the Dock Workers Union has been compensating a legal officer with a salary of Ksh. 152,000, despite the individual lacking the necessary qualifications and not being employed by the Board.
Additionally, there is an illegal payment involving Issa Kanda, a driver receiving Ksh. 35,000. It is crucial to highlight that although Issa is employed as a driver, the union has not operated a bus since it broke down five years ago, and he is over 60 years old, which should have prompted his retirement.
Furthermore, it has come to light that the union has been making payments to Maurice Munyao and Lawrence Nyawa without any justification. There is also a payment to Cynthia Wanyonyi, the Secretary General of Bottax Workers, who concurrently receives a monthly salary from the union. The EACC should investigate all these unlawful payments.
