Why has Khushi Motors Limited declined to provide compensation to Joseph Momanyi?

Image
The management of Khushi Motors Ltd has chosen not to compensate Joseph Momanyi, an accident victim, despite a legitimate court ruling. Momanyi is reportedly suffering in severe poverty as a result of the accident. The ruling by DKN Magare on 6/3/25, following an appeal, mandated that Momanyi be compensated with Sh350,000; however, to this day, no payment has been made. Is this not a case of contempt of court and impunity? This ruling came after Khushi Motors appealed against the judgment and decree issued by Hon. D.O. Mac’Andere (SRM) on 25.9.2023 in Kisii CMCC No. 468 of 2019. Khushi Motors submitted the Memorandum of Appeal dated 27.11.2023. It is evident that the grounds for appeal assert that the learned magistrate made errors in both fact and law regarding her findings on liability and the award of general damages. Liability was determined to be 100% in favor of the Respondent, with Ksh. 600,000 awarded in general damages. Momanyi had sought damages for an accident that all...

Auditor General has revealed significant issues of corruption and mismanagement, highlighting how Principal Herman Ndungu is exploiting parents

Image
There is increasing pressure on the TSC to promptly transfer Herman Ndungu from Larmudiac High School, following a report from the Auditor General that has uncovered his mismanagement and the misappropriation of public funds. This is not the first instance where parents, the local community, and stakeholders have urged for the principal's transfer due to the mismanagement of school resources. St. Joseph Larmudiac High School, once a symbol of balanced co-education, is now facing a crisis and has become a mere shadow of its former self. Parents, students, and the local community are now insisting that if the TSC does not transfer the principal by the end of the third term, they will not permit him to reopen the school in January. He is operating the school as if it were a private entity, where his decisions are final and akin to law, and those who express differing opinions are coerced, threatened, and intimidated. Since Ndungu's appointment in the middle of last year,...

Auditor General has revealed significant financial mismanagement at Barazani Girls' High School and has recommended that the Ethics and Anti-Corruption Commission investigate Principal Joy Muriuki

Image
The latest Auditor General's report for the fiscal year ending June 30, 2024, suggests that the Ethics and Anti-Corruption Commission conduct a comprehensive investigation aimed at prosecuting those found responsible for the mismanagement. The report indicates that public funds may have been misappropriated through a school fees cartel that has manipulated financial records, resulting in fictitious fee arrears totaling tens of millions of shillings. It is particularly concerning that Principal Joy Muriuki has enforced a “ZERO BALANCE” policy, requiring students to settle all fees before returning to school. This raises questions about how the school has accrued millions in fee arrears. This situation necessitates a thorough investigation. Stakeholders are urging the Teachers Service Commission to facilitate the transfer of the principal and appoint a new principal by January. Teachers have also expressed grievances regarding her management style, which they describe as ...

Mr. Chomba assumed leadership at Alliance on June 3, 2022, but has yet to effectively fill the substantial role left by his predecessor. His transfer was met with controversy and resistance from stakeholders; however, the Teachers Service Commission (TSC) did not reverse the decision as requested. The report indicates that the school's management, particularly regarding finances, is lacking. The principal asserts that the school is owed substantial sums of money, yet it is widely recognized that the institution operates on a 'ZERO BALANCE.' Consequently, parents are urging the Ethics and Anti-Corruption Commission (EACC) to thoroughly investigate the significant fees arrears and outstanding bill...
